In beginning your new life together, there are legal considerations to follow while planning your big day.

All people who marry in Massachusetts must have a marriage license issued in Massachusetts.  An out-of-state marriage license cannot be used.  You must follow the same protocol as a resident of the state of Massachusetts. State law requires that the bride and groom apply in person and jointly file marriage intentions with any city or town clerk in the Commonwealth.  The Wellfleet Town Clerk’s Office is located at 300 Main Street, Wellfleet, MA 02667, 508-349-0301.  You can file for a license Monday through Friday, 8:00 am to 4:00 pm, the fee is $ 40.00, cash or check (no credit cards).

Both applicants must be 18 years of age or older to file marriage intentions.  Otherwise, a court order must be obtained.    There is a mandatory 3 day waiting period from the date of application to the  date the license is issued. This can be waived following a hearing before a probate or district court judge  by appointment     After the waiting period  a designatedperson  needs  to pick up the license.  It is hand delivered to the solemnizer as the marriage cannot be performed without the license. If the solemnizer is from out of state or is not a member of the clergy then permission needs to be obtained from the Secretary of State at least two months in advance.  It is the responsibility of the of solemnizer to complete and sign the original license  and  return it to the city or town where the license was issued. A marriage license is valid for 60 days from the date  the license is issued and may be used in any Massachusetts city or town. Massachusetts statue does not require that any witnesses be present at your ceremony.
